These Terms of Service ("Terms") govern your access to and use of the JELQZ website at jelqz.com and any content, products, downloads, or services offered on it (the "Site"), operated by JELQZ ("we", "us", "our"). By accessing the Site, entering your email, downloading materials, or making a purchase, you agree to these Terms. If you do not agree, do not use the Site.
The Site concerns adult sexual-health and wellness topics. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally able to enter a contract to use the Site or purchase from us. By using the Site you represent and warrant that you meet these requirements. We do not knowingly provide services to minors.
All content, guides, videos, and programs offered on the Site are provided for general educational and informational purposes only. They are not, and must not be treated as, medical, health, psychological, legal, or professional advice. Using the Site does not create any doctor–patient or professional relationship between you and us.
We are not doctors, urologists, or licensed medical professionals, and nothing on the Site is a substitute for professional medical care. The techniques and information described may not be suitable for everyone and are not supported by conclusive clinical evidence. We make no guarantee, representation, or warranty that you will achieve any particular physical result, size change, performance change, or other outcome. Any results described, referenced, or implied are illustrative only, are not typical, and depend on individual factors outside our control. Your results, if any, are your own responsibility.
You understand that physical techniques carry inherent risks, including bruising, pain, and, in rare cases, injury. You voluntarily and knowingly assume all risk associated with your use of any information, technique, or product obtained through the Site, and you agree that you are solely responsible for how you apply it.
Paid products are digital and are sold at the prices displayed at the time of purchase, in U.S. dollars unless stated otherwise, exclusive of any applicable taxes. Payments are processed by our third-party payment provider, Stripe; by purchasing, you also agree to Stripe's terms. We do not receive or store your full payment-card details. We may correct pricing errors and refuse or cancel any order at our discretion. Charges are one-time unless a recurring charge is clearly disclosed before purchase.
Refunds are governed by our Refund Policy, which forms part of these Terms.
Some materials are offered free in exchange for your email address. By submitting your email you consent to receive the requested materials and related marketing messages from us. You may unsubscribe at any time using the link in our emails. See our Privacy Policy.
All content on the Site — including text, guides, PDFs, video, graphics, logos, and the JELQZ name and marks — is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use purchased or downloaded materials for your own personal, non-commercial use only. You may not copy, resell, redistribute, publish, or share the materials, or create derivative works, without our written permission.
You agree not to use the Site to violate any law; infringe our or others' rights; resell or redistribute our materials; attempt to gain unauthorized access to the Site or its systems; or interfere with the Site's operation.
The Site relies on and links to third-party services, including Stripe (payments), Google (reCAPTCHA and/or embedded YouTube video), and our hosting provider. We are not responsible for the content, policies, or practices of third parties, and your use of those services is subject to their terms.
To the fullest extent permitted by law, the Site and all products and content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
To the fullest extent permitted by law, in no event will we, our owners, officers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, or goodwill, or for any personal injury, arising out of or related to your use of the Site, the products, or any technique or information obtained through it, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Site or products will not exceed the amount you actually paid to us in the twelve (12) months before the event giving rise to the claim (or CAD $100 if you paid nothing). Nothing in these Terms excludes liability that cannot be excluded by law.
You agree to defend, indemnify, and hold us and our owners and affiliates harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.
We may modify, suspend, or discontinue the Site or any product at any time, and we may update these Terms by posting a revised version with a new "Last updated" date. Your continued use after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute not subject to mandatory consumer-protection rules in your home jurisdiction.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Site.
